Effective date: 17 October 2026
Publication: https://wuufy.com/terms
Effective date: 17 October 2026 Last updated: 17 October 2026
These Terms of Service (“Terms”) are a binding contract between you and Paw Ventures, LLC (“Paw Ventures,” “we,” “us,” or “our”), a Delaware limited liability company, 131 Continental Drive, Suite 305, Newark, Delaware 19713, United States. Paw Ventures operates the Wuufy mobile application, the website at wuufy.com, and the related pet-care software (together, the “Services”).
If your country of residence is Mexico, you contract with Petfit, S.A.P.I. de C.V., and the Spanish Términos de Servicio apply, even if the interface is in English. These English Terms apply if you reside in the United States or in another country that is not Mexico. Mandatory consumer, privacy, and health-data rights of your place of residence still apply.
Article 1. Acceptance
By creating an account, tapping to accept, connecting a wearable, or using the Services, you agree to these Terms and to the Wuufy U.S. Privacy Policy. If you do not agree, do not use the Services.
We may update these Terms by posting the new version in the app or on the website and, where the change is material, by an in-app notice or email. If you continue to use the Services after the effective date, you accept the update, except where the law of your state requires a fresh affirmative consent. The human-health consent in Section 12 is one of those consents: we will ask again before we collect a new category of health data or use an existing category for a new purpose.
Article 2. Eligibility
You must be at least 18 years old and able to form a contract. The Services are not directed to children. You may not create an account for a child or upload a child’s personal information.
You represent that you are the owner of each animal you add, or that the owner has authorized you to use the Services for that animal and to supply information about it. You are responsible for everyone who uses your account.
Article 3. Services
Wuufy is consumer software for people who live with dogs and cats. Depending on the features available in your build, the Services may include:
- a daily check-in that places your day beside your pet’s day;
- educational coaching sessions, short activity suggestions, and multi-day workout plans;
- logs, photos, and notes you choose to keep about your pet;
- informational replies from software, including the Wuufy Guru feature;
- visual triage aids, such as body-condition, stool, food-label, gait, or vomit screens, where that feature is turned on;
- an emergency prompt that tells you to contact a veterinarian or a 24-hour emergency animal hospital, and that can open your phone’s maps app; and
- a bite or incident report that helps you organize what happened and points you toward your own veterinarian and, where appropriate, a behavior professional.
Wuufy is a software publisher. It is not a veterinary hospital, not a training school, and not a human clinic.
Article 4. No veterinary practice
Paw Ventures does not practice veterinary medicine. No veterinarian-client-patient relationship is formed between you and Paw Ventures, or between your animal and Paw Ventures, because you use the Services.
The veterinary practice act of every U.S. state and territory reserves diagnosis, prognosis, treatment, prescription, and surgery to a person licensed in that jurisdiction who has established a veterinarian-client-patient relationship, generally after a timely physical examination of the animal. Wuufy does not hold a veterinary premise permit. The software is not licensed as a veterinarian in any state. A reply, score, ring, color, PDF, or push notification is not a diagnosis, a prognosis, a prescription, a treatment plan, or a medical record.
You must consult a veterinarian licensed where the animal is, for any question about the animal’s health, diet, medication, surgery, reproduction, or behavior that may have a medical cause. Do not start, stop, or change a drug, dose, food, or supplement because of something you read in Wuufy. The software is instructed not to prescribe and not to name a dose. If it nevertheless produces a drug name or a dose, disregard it and call a veterinarian.
Body-condition scores, gait notes, stool and vomit screens, food-label reads, and similar tools are pattern checks on information you supply. They are not a physical exam, not imaging, not a laboratory test, and not a determination that an animal is healthy. An “ideal,” “green,” or quiet result is not a clearance to exercise, breed, anesthetize, or delay a visit.
Any handoff summary or PDF the app generates is an owner-reported export of what you and the software recorded. It is not a veterinary medical record, not a SOAP note signed by a clinician, and not a second opinion. Give it to your own veterinarian if you wish. That veterinarian, not Wuufy, decides what it means.
Food comments are general information. Wuufy does not calculate a feeding amount, does not balance a homemade diet, and does not guarantee that a product is safe for your animal.
Article 5. No human medical practice
Wuufy reads certain wellness signals from your phone’s health store so it can compare your day with your pet’s day. That feature is general wellness software. It is not a medical device, not a clinical service, and not a health-care provider. Paw Ventures is not a HIPAA covered entity or a business associate on the strength of your consumer use of the app.
The Services do not diagnose, treat, cure, mitigate, or prevent any human disease or condition. They do not assess your cardiovascular, endocrine, sleep, psychiatric, or any other medical status. A readiness number, a mood tap, a heart-rate sample, a heart-rate-variability sample, a sleep duration, a step count, or a “quiet day” suggestion for your pet is not a statement about your health. Do not use it for a medical decision, an insurance decision, an employment decision, or an emergency.
If you are in crisis or thinking about harming yourself, contact local emergency services or the 988 Suicide & Crisis Lifeline (call or text 988 in the United States). If the app shows a crisis resource after language in a message, that screen is a pointer to those services. Wuufy does not operate a crisis line, does not monitor you in real time, and does not dispatch help.
Article 6. Animal emergencies
If an animal may be injured, in pain, unable to breathe, unable to urinate, having a seizure, collapsed, bleeding, bloated, overheated, or exposed to a toxin, contact a licensed veterinarian or a 24-hour emergency animal hospital immediately. Do not wait for the app.
Where the emergency feature is on, the software may match words or a photo to a fixed prompt, tell you to go to an emergency hospital, and offer to open Apple Maps or Google Maps for a “24 hour emergency” veterinary search. That prompt:
- is not emergency medical care and not an instruction from a veterinarian who has examined the animal;
- does not dispatch an ambulance, a clinic, or animal control;
- does not confirm that any hospital is open, nearby, equipped, or willing to see the animal;
- does not store your GPS coordinates (Section 13); and
- can be wrong, late, or unavailable if the network, the model, or your phone fails.
You alone decide whether to travel, what to tell the clinic, and whether to follow any first-aid sentence the software shows. Where a clinical advisory board has not approved a specific first-aid sentence, the app is designed to show a generic “go now” instruction instead. Either sentence can be incomplete. When in doubt, go.
Poison-control telephone lines and your own emergency clinic remain the right next call. A calculation the app shows about a possible toxin is not an all-clear at any band.
Article 7. Physical activity and training
Wuufy offers educational activity ideas and short plans for dogs and cats: walks, sniffing, settling, play, food puzzles, and similar low-equipment sessions, including plans that run for several days. This Article is a material term.
7.1 What the plans are
A plan, lesson, nudge, or “workout” is general educational content generated or selected by software from information in the account. It is not:
- a lesson delivered by a trainer who is with you;
- a program designed by a certified behavior consultant, a certified professional dog trainer, or a veterinary behaviorist for this animal;
- physical therapy, rehabilitation, or a post-operative protocol;
- a guarantee that behavior will change, that a hazard will diminish, or that an animal will be safe around people or other animals; or
- supervision. We cannot see the session, the space, the weather, the equipment, or the animal’s face unless you later send us a photo or a clip.
Wuufy does not employ a trainer at your home and does not accept custody of your animal.
7.2 Assumption of risk
Physical activity with an animal, and behavior work around an animal, can cause serious injury or death to you, to the animal, to another person, or to another animal. Foreseeable risks include bites, scratches, falls, collisions, pulled muscles and damaged joints, heatstroke, respiratory collapse (including in short-nosed breeds), cardiac events, bloat, ingestion of a foreign body or a food used for enrichment, zoonotic disease, injury in traffic or near water, fights with other animals, and damage to property. Behavior work can also make fear or aggression worse if it is mistimed.
You knowingly assume those risks to the fullest extent the law of your state allows, for yourself and for the animal, when you choose to perform a suggestion. You are responsible for choosing a safe place, a safe duration, appropriate equipment, and weather your animal can tolerate, and for stopping.
7.3 Your duties before and during a session
You agree that:
- you will obtain a veterinarian’s clearance before you begin a physical plan if the animal is a puppy or kitten, a senior, brachycephalic (including Bulldog, French Bulldog, Pug, Boxer, Boston Terrier, Shih Tzu, and similar conformations), pregnant, nursing, overweight, recovering from surgery or illness, or known to have an orthopedic, neurologic, respiratory, or cardiac condition;
- a shorter walk, a “sniff” suggestion, or a gentle plan inside the app is not that clearance. Those substitutions depend on profile fields you typed. If the fields are wrong, the plan will be wrong;
- you will watch the animal and stop at once on limping, stiffness, coughing, noisy breathing, excessive panting, drooling, vomiting, pale or blue gums, wobbling, refusal, hiding, growling, snapping, or any other sign of pain, fear, or heat stress;
- you will not ask a child to run a session, and you will not leave a child alone with an animal during a session;
- you will comply with leash laws, dangerous-dog laws, vaccination and license rules, housing rules, and park rules where you are;
- you will not use a suggestion that conflicts with a protocol your own veterinarian or behavior professional already gave you; and
- food puzzles, lick mats, and chews are your responsibility to size, supervise, and clear so they are not a choking or obstruction hazard.
7.4 No outcome promise
Animals differ. Software cannot promise house training, leash manners, a quieter household, a resolved fear, or a dog who will not bite. Progress, regression, and plateau are all ordinary. If a plan feels wrong, skip it.
7.5 Release for training injuries
To the fullest extent permitted by the law of your state of residence, you release Paw Ventures and its members, managers, employees, contractors, and licensors from claims arising out of an injury, illness, death, or property loss that results from your decision to perform, adapt, or ignore a training or activity suggestion, including claims of ordinary negligence in how a suggestion was worded or selected.
This release does not apply to gross negligence, recklessness, willful misconduct, or fraud. It does not apply to the extent a statute in your state refuses to enforce a pre-injury release. New York General Obligations Law § 5-326, and similar statutes in other states that void releases for paid recreational establishments, may limit this Section if a court treats a paid plan as that kind of service. Consumer-protection statutes, including the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act, the California Consumer Legal Remedies Act and Unfair Competition Law, the Texas Deceptive Trade Practices Act, and comparable laws, are not waived. Section 21 states the same limit for the rest of these Terms.
Article 8. Bites and incident tools
A bite, scratch, or near-miss is a safety event. Your duties under local animal-control and public-health law (quarantine, rabies documentation, reporting) are yours. Wuufy does not report to animal control for you and does not determine rabies risk.
Incident and “Safeguard” tools, where present, organize answers you type and may show a color, a scale reference (such as a bite scale or a feline aggression ladder), and a suggestion to see your veterinarian first, to rule out pain, and a behavior professional for a hands-on plan. A color is not a finding that an animal is safe to keep, safe to rehome, or required to be euthanized. A yellow or red state is not a diagnosis. The chat staying available during that state is not permission to practice exposure, desensitization, or threshold work. Do not run those protocols from a consumer app. A qualified behavior professional should design them in person, after a veterinarian has examined the animal.
If a person has been bitten, tend to the person first and follow local medical and reporting rules.
Article 9. Artificial intelligence
Parts of the Services are produced by machine-learning models operated by us or by a processor such as Google. Models misread photos, invent facts, miss emergencies, and sound more certain than they are. They do not know what your veterinarian saw last week unless that fact is in the account, and even then they can ignore it.
You will not rely on a model output as professional advice. You will use your own judgment and, for health and behavior questions, a licensed professional who has seen the animal. We may refuse, shorten, or add a fixed safety sentence to a reply. We do not promise that every dangerous message will be caught.
Do not submit information you are not allowed to share, including another person’s health data or a veterinary record that names a person, unless you have the authority and you accept the privacy terms that apply to it.
Article 10. User information
Profile fields, weights, breeds, ages, conditions, vaccines, moods, and diary notes are self-reported. We do not verify them against a clinic. Inaccurate inputs produce inaccurate outputs. You are responsible for what you enter and for what anyone using your account enters.
Photos and video must be yours, or you must have the owner’s permission and, if a person is identifiable, that person’s permission. Do not upload images of children. A walk clip may incidentally include you; do not include other people who have not agreed.
Article 11. Subscriptions
Paid features, prices, trials, and renewal periods are shown in the purchase screen before you confirm. Apple, on the App Store, and Google, on Google Play, collect and store the payment card and the store account identity. Paw Ventures never receives the card number, the card security code, or a government identification number. We receive only a subscription status and a store transaction reference from Apple, Google, and our subscription-status processor, RevenueCat. Deleting the app, or deleting your Wuufy account, does not cancel a store subscription. Cancel in your Apple ID or Google Play account settings at least 24 hours before the renewal time. Refunds are handled by the store under its rules, except where the law of your state requires us to handle them.
If a safety feature is offered without a subscription, that feature remaining free does not make the rest of the Service free and does not create a duty to keep any particular feature online forever.
You can export a copy of your account data, and you can delete the account, from Settings in the app. Deletion asks for your password. It removes the account from use and deletes the human wearable rows and daily check-ins along with the pet records. It does not cancel an Apple or Google subscription.
Article 11A. Employer subscriptions
An employer may buy Wuufy as a benefit for people who use a work email on that employer’s domain. The employer’s subscription is billed to the employer, on a corporate domain. Consumer mailboxes (for example Gmail, iCloud, Outlook, Hotmail, Yahoo, and Proton) cannot be an employer domain. Apple and Google still handle any card the employer uses at a store. They do not send that card to us.
The employer never receives employee data. We do not disclose to the employer, to its HR staff, or to its insurer or broker:
- your name, email, account identifier, or the fact of any particular check-in;
- your pet’s name or records;
- steps, sleep, heart rate, resting heart rate, heart-rate variability, active minutes, readiness score, or a wearable screenshot;
- your mood on any day;
- chat, photos, or support messages.
The only thing an employer who pays may receive is an aggregate for its email domain, and only after the anonymity floor is met. The floor is fixed in the product: the report is produced only when at least 50 different people on that domain have a check-in in the period asked about. Fewer than 50 produces no report at all, not a report of a smaller group. The employer cannot lower the floor.
When the floor is met, the report contains only: how many people, how many check-ins, the average human mood and the average pet mood expressed as a percent, and the share of check-ins that had some wearable reading attached. It does not contain the reading. It does not contain a name, a pet, a day that belongs to one person, or a biometric value.
Signing up with a work email on a domain that has this benefit means your check-in can count toward that anonymous average. It does not identify you. Deleting your account removes your check-ins from later reports. Using a personal email keeps you out of every employer pool.
No employer dashboard is delivered until it calls this same gate. A report that skipped the gate would breach these Terms.
Article 12. Authorization for human wearable data
This Article governs the Apple Health and Health Connect permissions. The Privacy Policy states the same uses. If they differ, the narrower use controls.
If you choose to connect Apple Health (HealthKit) on an iPhone, or Health Connect on Android, you authorize Paw Ventures to read, and only to read, the types the permission screen lists. In the current Services those types are:
- steps;
- sleep;
- heart-rate variability (SDNN from Apple Health, RMSSD from Health Connect);
- heart rate;
- resting heart rate; and
- active minutes.
The daily check-in uses steps, sleep, and heart-rate variability. Heart rate, resting heart rate, and active minutes are read when you connect the smartwatch path that requests them. The phone may reduce steps, sleep, and heart-rate variability to a readiness integer from 0 to 100 and send that integer. We do not rebuild your medical history from it.
We use these data only to:
- show your activity and rest beside that day’s pet check-in;
- decide whether to offer a shorter or quieter pet routine; and
- record that you and the pet may have walked on the same day, using distance or step agreement, not a map of where you went.
We do not write into Apple Health or Health Connect. We do not read health data in the background beyond what the operating system allows for a foreground sync you have enabled. We do not sell these data. We do not share them for advertising, marketing, credit, insurance, employment, or data-broker use. We do not use them to diagnose you. We do not allow a processor to use them for its own purposes.
A screenshot you take of a watch or a phone health screen is a separate path. If you submit one, you authorize us to send that image to our AI processor so it can read the numbers, and to store the resulting steps, sleep, and heart-rate variability on your account for the same uses. Do not photograph a screen that shows a diagnosis, a medication, another person’s data, or an account number.
You can stop the read in Wuufy settings. On Android, disconnect also revokes the Health Connect permission. On iPhone, iOS does not let an app revoke Health access; disconnect stops our reads, and you turn the system permission off in the Health app. You may also delete your account, which deletes the human-health rows we hold, as described in the Privacy Policy.
Declining the connection does not close the account. The check-in still accepts a mood tap with no wearable.
Article 13. Location
The only location feature is the emergency-hospital search. When you tap it, the phone may read a coarse position, build a maps link on the device, and hand that link to Apple Maps or Google Maps. The coordinates are not sent to the Wuufy API, not written to our database, not written into analytics or crash logs, and not kept after the maps app opens. If you deny permission, the app opens maps on a text search instead. We do not build a home address, a trail, or a geofence from this feature. We do not geofence health-care facilities.
Article 14. License
You keep ownership of photos, video, text, and other material you submit (“User Content”).
For User Content about an animal, you grant Paw Ventures a non-exclusive license to host, reproduce, and display it to operate the Services and to keep the account. Identifiable User Content is deleted or dissociated when you delete the account, except copies we must keep for a legal claim, a tax rule, or a security investigation. This license is not a right to put your animal in an advertisement. We will use a pet image in advertising only with a separate opt-in that you can withdraw going forward.
Science donation is separate from that license and is described in Section 14A. Creating an account does not donate the animal’s data.
For human health data, including wearable readings, readiness scores, mood taps, and screenshots of a human wearable, the only license you grant is the license to process them for the uses in Section 12 and the Privacy Policy. There is no promotional license, no sale, and no license to train a general-purpose model unrelated to operating this pet feature. You can end this license by disconnecting and deleting the account, subject to short backup cycles and to records we must retain by law.
You represent that you have the rights you need to grant these licenses.
Article 14A. Science donation of pet data
Pet profiles, pet logs, and photos and video of the animal may be used for animal-health research and to train animal-care models. The donation is off until the User turns on research sharing in Settings. Leaving the control off is a refusal. Turning it off later ends further donation. The Services operate the same in either case. Account creation is not consent. Silence is not consent.
A photo of a wearable screen is a second, narrower switch. We keep that image for research only when you mark that photo as donated. If you do not mark it, the image is deleted after the numbers are read. The numbers themselves stay on the account for the feature you asked for, and they are not a science donation.
The donation never includes your human health data: steps, sleep, heart rate, resting heart rate, heart-rate variability, active minutes, readiness, the mood you tap for yourself, or a screenshot of your own watch or health screen. It is not shared with an employer.
Before pet material is used for research, we remove your name and email. When you turn the setting off or delete the account, we delete identifiable copies of what you had donated. A de-identified pattern already inside a trained model cannot be pulled back out of that model.
Article 15. Acceptable use
You will not:
- use the Services for an emergency in place of a veterinarian or, for yourself, in place of emergency services;
- rely on the Services to meet a legal duty you owe as an owner, a handler, or a licensed professional;
- upload unlawful, infringing, or exploitative content, including sexual content involving minors;
- attempt to extract, copy, or reverse engineer the models, prompts, or source, except to the extent a statute forbids that restriction;
- probe, scrape, or overload the Services, or bypass an entitlement or safety check;
- submit another person’s human health data without authority; or
- present Wuufy output as a veterinary certificate, a health certificate, or an official record.
We may suspend an account that creates a safety risk, a security risk, or a material breach. Safety prompts that the product treats as free remain available where we can keep them available without running the rest of the account.
Article 16. Intellectual property
The Services, the Wuufy name and marks, the software, and our text and design belong to Paw Ventures or its licensors. These Terms do not assign any of that to you. You may use the Services for your own household, non-commercial pet care. You may not resell access, build a competing model from our outputs in bulk, or remove proprietary notices.
Article 17. Third parties
Apple, Google, RevenueCat, and the maps app you open are independent services with their own terms. A clinic, trainer, insurer, or shop you contact outside the app is not our agent. We do not warrant their availability, prices, or care. If the Apple Licensed Application End User License Agreement would apply and conflicts with these Terms, Apple’s standard end-user terms control as between you and Apple, and these Terms control as between you and Paw Ventures. You acknowledge that Apple and Google are not responsible for the Services or for any veterinary or training claim.
Article 18. Disclaimer of warranties
To the fullest extent permitted by the law of your state of residence, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, and non-infringement, and any warranty arising from course of dealing. We do not warrant that an output is accurate, complete, current, or safe for a particular animal; that the Services will be uninterrupted or free of security incidents; or that a plan will produce a behavioral result.
Some states do not allow an implied-warranty disclaimer, or limit it. In those states the disclaimer applies only to the extent allowed, and any implied warranty that cannot be disclaimed lasts only as long as the minimum period that state requires. Paw Ventures does not disclaim a warranty or a remedy that the law of the User’s state forbids it to disclaim, including under the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act.
Article 19. Limitation of liability
To the fullest extent permitted by the law of your state of residence, Paw Ventures and its members, managers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of the Services or these Terms, even if advised of the possibility.
To the fullest extent permitted by that law, our aggregate liability for all claims arising out of the Services in a twelve-month period will not exceed the greater of (a) the amount you paid us for the Services in that period or (b) one hundred U.S. dollars (US $100).
These limits do not apply to liability that a state refuses to limit, including, as applicable: gross negligence, recklessness, willful misconduct, or fraud; death or personal injury caused by our negligence where your state forbids that limit; a breach of a non-waivable consumer-protection or privacy statute; and a duty to pay a statutory penalty. They do not limit your right to an injunction for a non-waivable privacy right.
The Services are a software tool priced as consumer software. The limits in this Section are a bargained allocation of risk. Without them we would not offer the Services at this price. You are in a better position than we are to insure the animal, the household, and the way you choose to use a suggestion.
Article 20. Indemnity
To the fullest extent permitted by the law of your state, you will defend and indemnify Paw Ventures and its members, managers, employees, and contractors against third-party claims, damages, and reasonable attorneys’ fees arising out of: your User Content; your breach of these Terms; a false or incomplete fact you entered; an injury arising from a session you chose to run; or your violation of a veterinary-practice, dangerous-dog, or privacy law.
This indemnity does not require you to indemnify us for our own gross negligence, recklessness, willful misconduct, or fraud, or for a claim that a statute says a consumer cannot be made to indemnify. We will give you prompt notice of a claim, and we may participate with our own counsel.
Article 21. Disputes
This Article does not apply where the law of the User’s state forbids it, and it does not apply to a non-waivable privacy or consumer claim that must be brought in a particular forum.
21.1 Informal notice
Before filing a claim, you and we will try to resolve it. Send a written notice to contact@wuufy.com with your name, the email on the account, a short description, and the relief you want. We will do the same if we have a claim against you. If the claim is unresolved 30 days after that notice, either party may start arbitration or, where this Section allows, a court case.
21.2 Arbitration
Except for the carve-outs in Section 21.4, any dispute arising out of these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs the interpretation of this agreement to arbitrate. The arbitrator may award any individual relief a court could award, including statutory damages, and may not preside over a class or consolidated proceeding. The seat of arbitration is Wilmington, Delaware, and the hearing may be held by video or, if an in-person hearing is required, in the county of your residence. Judgment on the award may be entered in any court with jurisdiction.
21.3 Class waiver
To the fullest extent permitted by law, you and Paw Ventures will bring claims only in an individual capacity, and not as a plaintiff or class member in a class, collective, or representative action. If a court finds this waiver unenforceable as to a particular remedy, that remedy will proceed in court and the rest of the dispute will remain in individual arbitration. Public injunctive relief under California law is not waived (McGill).
21.4 Carve-outs
Either party may bring an individual action in small-claims court. Either party may seek provisional injunctive relief in court for misuse of intellectual property or unauthorized access. Claims that a statute says cannot be arbitrated, including certain non-waivable privacy claims, may be brought in the forum that statute specifies.
21.5 Opt-out
You may opt out of Sections 21.2 and 21.3 by emailing contact@wuufy.com within 30 days after you first accept these Terms. The email must come from the address on the account and include the statement “Arbitration opt-out” and your name. Opting out does not affect other Sections. If you opt out, and if a claim is not required to be heard elsewhere, the state and federal courts located in Newark, Delaware will be the exclusive venue, except that you may also sue in the county of your residence where the law of that state requires it, and we may sue you there.
21.6 Time limit
To the extent permitted by the law of your state, a claim must be filed within one year after it accrues, or it is barred. This shorter period does not apply to a claim for which a state sets a period that cannot be shortened by contract.
Article 22. Governing law
These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-laws rules that would apply another state’s law, and by the Federal Arbitration Act for Section 21. The mandatory consumer-protection, privacy, health-data, and veterinary-practice laws of the state where you reside apply to you and are not displaced. Those laws include, where you reside there, the California Consumer Privacy Act as amended by the California Privacy Rights Act, the Washington My Health My Data Act, the Nevada consumer-health-data law, the Connecticut Data Privacy Act, the Colorado Privacy Act, the Virginia Consumer Data Protection Act, the Texas Data Privacy and Security Act, the Oregon Consumer Privacy Act, the Maryland Online Data Privacy Act, the Minnesota Consumer Data Privacy Act, the New Jersey comprehensive privacy law, and the other state privacy laws identified in the Privacy Policy, together with each state’s veterinary practice act and unfair-trade-practices statute.
Article 23. State terms
California. You waive California Civil Code § 1542 only to the extent Section 7.5 or Section 19 applies and only as to claims you know enough to understand. Section 1542 provides that a general release does not extend to claims the creditor does not know or suspect to exist in their favor at the time of executing the release, which if known would have materially affected the settlement. A waiver that the law treats as against public policy, including Civil Code § 1668 (fraud, willful injury, or violation of law), has no effect. Automatic-renewal terms are disclosed at purchase under Business and Professions Code §§ 17600 and following; cancel through the store that billed you. Privacy rights are in the Privacy Policy and cannot be waived here.
New York. General Obligations Law § 5-326 may make a pre-injury release unenforceable for certain paid recreational facilities. If a court applies that statute, or General Business Law § 349, to a training claim, Section 7.5 yields and the rest of these Terms remain. You may also have rights under the New York SHIELD Act as described in the Privacy Policy.
New Jersey. Nothing in these Terms removes a right or remedy the Truth-in-Consumer Contract, Warranty and Notice Act preserves. Any sentence that would do so is rewritten to the closest lawful version.
Illinois. We do not collect biometric identifiers or biometric information as the Biometric Information Privacy Act defines them (fingerprints, voiceprints, retina scans, or face geometry used to identify a person). A pet photo or a gait clip is not used to build a human biometric template. If that ever changed, we would obtain the written consent and publish the retention schedule that statute requires before collection.
Washington and Nevada. Consumer health data is handled under the Privacy Policy. Those statutes cannot be waived in these Terms. We do not sell consumer health data.
All states. If you reside in a state that requires a particular disclosure, cancellation method, or venue for consumer claims, that requirement controls over a conflicting sentence in these Terms.
Article 24. General
These Terms, the Privacy Policy, and the in-app human-health consent are the entire agreement between you and Paw Ventures about the Services. If a provision is unenforceable, it is modified to the minimum extent required, and the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms. We may assign them to an affiliate or a successor of the business, provided your privacy rights travel with the assignment. Headings are for convenience. The English text controls for accounts governed by these Terms. Sections 4 through 11A, 12, 14, 14A, and 18 through 23 survive termination.
We are not responsible for delay caused by a network, a store, a cloud provider, a labor dispute, or any cause beyond our reasonable control. Safety routing that is designed to fail closed (a generic “go to an emergency hospital” result) is not such a delay; it is the designed fallback, and it is still not veterinary care.
